2. Services

We provide digital marketing services including SEO, paid advertising management, social media marketing, e-commerce consulting, branding and analytics. The scope, deliverables and fees for each engagement are defined in a written proposal or agreement.

3. Fees and payment

Retainer fees are invoiced monthly in advance. Advertising spend is paid directly to the relevant platforms by the client unless otherwise agreed. Late payments may result in suspension of services.

4. Term and cancellation

Unless otherwise agreed, engagements are month-to-month and may be cancelled by either party with 30 days' written notice.

5. Client responsibilities

Clients agree to provide accurate information, timely approvals and necessary account access. Clients are responsible for ensuring their products and claims comply with applicable laws and platform policies.

6. Results

Marketing results depend on many factors outside our control. While we work to achieve agreed objectives, we do not guarantee specific rankings, traffic, sales or returns.

7. Intellectual property

Upon full payment, clients own the final deliverables created specifically for them. We retain ownership of our internal tools, methods and templates.

8. Limitation of liability

To the maximum extent permitted by law, Pixelcommerce LLC shall not be liable for indirect, incidental or consequential damages. Our total liability is limited to the fees paid in the three months preceding the claim.

9. Governing law

These Terms are governed by the laws of the State of New Mexico, United States.
